Waiver

ASSUMPTION OF RISK

I understand that participation in activities at Jump‘n’Joy involves inherent risks, including but not limited to:

• Collisions with objects, equipment, or other participants
• Falling, slipping, or tripping
• Equipment malfunction or improper use
• Enjuries resulting from physical activity
• Illness, including the spread of infectious disease

I voluntarily assume all risks, known or unknown, on behalf of myself and Minor Participants.

Physical Fitness

I affirm that I and the Minor Participants are in good physical health and have no medical conditions that would prevent safe participation.

RELEASE OF LIABILITY

On behalf of myself and the Minor Participants, I hereby release, discharge, and hold harmless Jump‘n’Joy and all Released Persons from any and all claims, including but not limited to:

• Personal injury or bodily harm
• Property damage or loss
• Emotional distress
• Illness or death

This release applies to claims arising from negligence or any other cause, to the maximum
extent permitted by law.

PROPERTY LIABILITY

I acknowledge that Jump‘n’Joy and its staff are not responsible for personal property that is lost, stolen, or damaged on the premises, including vehicles, belongings in lockers or cubbies, or other items.

PHOTO & PUBLICITY RELEASE

By entering Jump‘n’Joy, I grant permission for myself and the Minor Participants to be photographed or recorded. I authorize Jump‘n’Joy to use these photos or recordings for promotional purposes, including advertisements, social media, and other media platforms, without compensation.

INDEMNIFICATION

I agree to indemnify and hold harmless the Released Persons from any claims, damages, or expenses arising from my or the Minor Participants’ actions while on the premises.

LEGAL FEES & COSTS

If I file a lawsuit against Jump‘n’Joy or any Released Persons and it is determined that Jump‘n’Joy or the Released Persons are not liable, I agree to reimburse all legal fees, court costs, and expenses incurred by Jump‘n’Joy or the Released Persons in defending such claims.

If Jump‘n’Joy or any Released Person must take legal action to enforce this waiver or collect payments due, I agree to pay all attorney’s fees and related costs incurred in such actions.

AGREEMENT NOT TO SUE

I, on behalf of myself and any Minor Participants, agree not to sue or file any legal action against Jump‘n’Joy or any Released Persons for any claims or causes of action arising out of participation in activities at Jump‘n’Joy, except where such claims are the result of gross negligence or intentional misconduct by Jump‘n’Joy.

TERM OF AGREEMENT

This waiver remains in effect indefinitely and applies to all visits to Jump‘n’Joy, now and in the future.

VENUE AND MEDIATION

I agree that any disputes will be resolved exclusively in the Noida Court. I further agree to participate in mediation to resolve disputes before pursuing legal action.

SEVERABILITY

If any portion of this agreement is found unenforceable, the remaining terms will remain in full effect.

HOUSE RULES

General Safety

• PLAY AT YOUR OWN RISK.
• Children must be supervised by an adult (18+) at all times.
• No running, pushing, roughhousing, or climbing outside designated areas.
• Sharp objects, jewelry, and hazardous items must be removed before play.

Hygiene & Cleanliness

• Non slip Socks are required in all play areas. No shoes, bare feet, or inappropriate footwear allowed.
• No food, drinks, or gum in play areas.
• Guests showing signs of illness will be asked to return when fully recovered.
• Please clean up after use of toys, equipment, and art supplies.

Behavior

• No aggressive or disruptive behavior.
• Play responsibly and respect other guests and staff.
• Follow staff instructions to ensure a safe environment for everyone.

Failure to adhere to these rules may result in removal from the Facility.
